1. About Nomi

Nomi is an AI-powered customer support platform operated by A. Moradi, based in the Netherlands ("we", "us", "our"). Nomi allows businesses to deploy AI chat assistants on their websites that answer customer questions automatically using content provided by the customer.

By accessing or using Nomi, you ("you", "the client", "the user") agree to be bound by these Terms of Service and our Privacy Policy.

2. Account Registration

To use Nomi you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and not share them with others
• Notify us immediately at [email protected] if you suspect unauthorised access to your account
• Be responsible for all activity that occurs under your account

You must be at least 18 years old to create an account. By registering you confirm that you meet this requirement.

3. Free Trial

New accounts receive a 14-day free trial with full access to all features of the selected plan. No credit card is required to start the trial. At the end of the trial period, continued use of Nomi requires a paid subscription. If you do not subscribe, your account will be deactivated and your data retained for 30 days before deletion.

4. Subscriptions and Payment

Nomi offers the following subscription plans billed monthly:

• Starter — €99 per month
• Pro — €299 per month
• Enterprise — €599 per month

All payments are processed securely by Stripe. By subscribing you authorise Stripe to charge your payment method on a recurring monthly basis until you cancel.

Prices are exclusive of VAT where applicable. Dutch VAT regulations apply to clients based in the Netherlands.

5. Cancellation and Refunds

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. You will not be charged for subsequent periods after cancellation.

We do not offer refunds for the current billing period after payment has been processed. The 14-day free trial exists to allow you to evaluate the service before committing to payment.

6. Acceptable Use

You agree to use Nomi only for lawful purposes. You must not use Nomi to:

• Spread false or misleading information
• Harass, abuse, or harm any person
• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Upload content that is illegal, offensive, or violates third-party rights
• Attempt to gain unauthorised access to our systems
• Resell or sublicense the Nomi service without our written permission

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Your Content

You retain full ownership of all documents, FAQs, and other content you upload to Nomi ("Your Content"). By uploading content you grant us a limited licence to process and store it solely for the purpose of operating your AI bot.

You are solely responsible for ensuring that Your Content does not infringe the rights of any third party and complies with all applicable laws.

You can delete Your Content at any time from your dashboard. Upon account deletion, all Your Content is permanently deleted within 30 days.

8. Availability and Uptime

We aim to maintain 99.9% uptime for the Nomi service. However, we do not guarantee uninterrupted availability. The service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

Enterprise plan clients receive an SLA uptime guarantee as specified at the time of agreement.

We will communicate planned maintenance and any significant outages by email and will restore service as quickly as possible.

9. Limitation of Liability

To the maximum extent permitted by applicable Dutch law, Nomi and A. Moradi shall not be liable for:

• Any indirect, incidental, or consequential damages arising from your use of the service
• Loss of revenue, profits, or business opportunities
• Inaccurate or incomplete responses generated by the AI
• Data loss resulting from technical failures
• Any damages exceeding the total amount you paid to us in the three months preceding the claim

The AI responses generated by Nomi are based on the content you provide. We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated response.

10. Intellectual Property

The Nomi platform, including its software, design, and branding, is owned by A. Moradi and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the platform without our written permission.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of Nomi after changes take effect constitutes acceptance of the updated terms.

If you do not agree with updated terms, you may cancel your subscription before the changes take effect.

12. Governing Law

These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from these terms or your use of Nomi shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

For consumers in the EU, mandatory consumer protection rights under your local law are not affected by this clause.
